Purchasing a Residential Property

NOTE: We will explain to you all the various enquiries so you can choose which ones are appropriate for your property. Banks and other lenders may require certain enquiries to be made. These are the most common enquiries made but other enquiries may be necessary depending on the type of property.

Stamp Duty (a State Government tax), which is usually the greatest cost associated with your purchase, is payable on the contract and also on any Mortgage. The amount payable depends on the purchase price of the property and the amount of the Mortgage.

Depending on the purchase price, first home buyers may be exempt from Stamp Duty or entitled to a discount. To calculate Stamp Duty go to the web site of the NSW Office of State Revenue www.osr.nsw.gov.au (see links).

Once on that site click on “Calculators” and calculate Stamp Duty on the Transfer of Land and Mortgage. First home buyers calculate their stamp duty under First Home Plus which is the name of the scheme which provides exemptions and discounts on Stamp Duty to first home buyers.

It is a legal requirement that any person undertaking to sell a residential property must prepare a proposed contract and have it available, (usually with the Agent) for intending buyers to look at. The law requires certain documents to be attached to the contract, including the following:

Council s149(2) Certificate - $40.00
Sewer Diagram - $23-55
Titles Searches - these vary according to the property but would not usually exceed - $95.00
